  • Employers, recruiters, and authorized representatives of organizations seeking recruitment services (“Employers”).

By using the Platform, you represent and warrant that:

  • You are legally capable of entering into binding contracts.
  • All information provided is accurate and truthful.
  • You are authorized to act on behalf of any organization you represent.

3. User Accounts and Responsibilities

3.1 Account Registration

To access certain features of the Platform, Users may be required to create an account. You agree to:

  • Provide accurate, current, and complete information.
  • Maintain and promptly update your information.
  • Use only your own identity and credentials.

Smart Hiring Gulf reserves the right to verify user information and may suspend or terminate accounts that provide false or misleading information.

3.2 Account Security

You are solely responsible for:

  • Maintaining the confidentiality of login credentials.
  • All activities conducted under your account.
  • Immediately notifying us of unauthorized access or security breaches.

Smart Hiring Gulf shall not be liable for any loss resulting from unauthorized use of your account due to your failure to safeguard credentials.


4. Use of the Platform

4.1 Permitted Use

Users may use the Platform solely for lawful recruitment and job-seeking purposes, including:

  • Posting legitimate job vacancies (Employers).
  • Submitting applications for employment (Job Seekers).
  • Accessing recruitment-related information and services.

4.2 Prohibited Conduct

Users shall not:

  • Post false, misleading, or fraudulent job listings or resumes.
  • Misrepresent identity, qualifications, or affiliations.
  • Upload unlawful, defamatory, obscene, or discriminatory content.
  • Use the Platform for harassment or exploitation.
  • Engage in scraping, data mining, automated extraction, or reverse engineering.
  • Attempt unauthorized access to systems or data.
  • Introduce viruses, malware, or harmful code.
  • Use the Platform for any activity that violates applicable laws in GCC jurisdictions or internationally.

Smart Hiring Gulf reserves the right to remove content or restrict access at its sole discretion.


5. Employer-Specific Obligations

Employers using the Platform agree that:

  • Job postings must be genuine, lawful, and compliant with applicable labor laws.
  • Compensation, qualifications, and job details must be accurate.
  • They will use candidate information solely for recruitment purposes.
  • They will comply with all applicable employment and data protection laws in the relevant GCC jurisdiction.

Smart Hiring Gulf does not guarantee the suitability, background, or qualifications of any candidate.


6. Job Seeker-Specific Obligations

Job Seekers agree that:

  • All resume information is accurate and truthful.
  • Submitted credentials and certifications are valid.
  • They will not apply for roles with fraudulent intent.
  • They understand that hiring decisions are solely at the discretion of Employers.

Smart Hiring Gulf does not guarantee job placement, interviews, or employment outcomes.


7. Intellectual Property Rights

7.1 Platform Ownership

All content, software, trademarks, logos, designs, databases, and materials on the Platform (excluding user-submitted content) are the exclusive property of Smart Hiring Gulf or its licensors and are protected by applicable intellectual property laws.

Users may not reproduce, distribute, modify, or commercially exploit Platform content without prior written consent.

7.2 User-Generated Content

Users retain ownership of content they upload (e.g., resumes, job postings). However, by submitting content, you grant Smart Hiring Gulf a non-exclusive, worldwide, royalty-free license to:

  • Use, reproduce, store, and display such content.
  • Share it with relevant Employers or Job Seekers.
  • Process it for recruitment-related purposes.

You warrant that you have the legal right to upload such content.


8. Fees and Payments (If Applicable)

If certain services require payment:

  • Fees will be clearly communicated.
  • Payments must be made in accordance with agreed terms.
  • Smart Hiring Gulf reserves the right to suspend services for non-payment.
  • Unless otherwise stated, fees are non-refundable.

9. Disclaimers

9.1 No Employment Guarantee

Smart Hiring Gulf acts as a recruitment facilitation platform only. We do not:

  • Guarantee job placement.
  • Guarantee candidate selection.
  • Endorse any specific Employer or Job Seeker.

9.2 Accuracy of Information

We do not warrant the accuracy, reliability, or completeness of:

  • Job postings.
  • Candidate profiles.
  • Third-party content.

Users are responsible for conducting their own due diligence.

9.3 Platform Availability

The Platform is provided on an “as-is” and “as-available” basis. We do not guarantee:

  • Continuous availability.
  • Error-free operation.
  • Freedom from viruses or harmful components.

We reserve the right to modify or discontinue services at any time.


10. Limitation of Liability

To the fullest extent permitted by applicable law:

Smart Hiring Gulf shall not be liable for:

  • Any indirect, incidental, special, or consequential damages.
  • Loss of profits, business, data, or goodwill.
  • Employment decisions made by Employers.
  • Misrepresentation by Job Seekers.
  • Unauthorized access to user accounts.

In no event shall our total liability exceed the amount paid by the User (if any) in the preceding six (6) months.


11. Indemnification

You agree to indemnify, defend, and hold harmless Smart Hiring Gulf, its affiliates, directors, employees, and partners from any claims, liabilities, damages, losses, or expenses arising out of:

  • Your use of the Platform.
  • Your violation of these Terms.
  • Your infringement of third-party rights.
  • Any content you upload or share.

12. Suspension and Termination

Smart Hiring Gulf reserves the right to:

  • Suspend or terminate accounts without notice for violations of these Terms.
  • Remove content deemed inappropriate or unlawful.
  • Deny access to the Platform at its discretion.

Upon termination:

  • Your right to access the Platform ceases immediately.
  • Certain provisions (e.g., limitation of liability, indemnification) shall survive termination.

13. Compliance with Laws

Users agree to comply with all applicable laws and regulations, including:

  • Labor and employment laws.
  • Anti-discrimination laws.
  • Data protection and privacy regulations.
  • Cybercrime laws applicable within GCC jurisdictions.

14. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the United Arab Emirates (UAE).

Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the competent courts of the UAE, unless otherwise required by mandatory provisions of applicable GCC laws.

Where Smart Hiring Gulf operates in other GCC jurisdictions, local mandatory legal provisions shall apply where required by law.

We reserve the right to modify these Terms at any time. Updated versions will be posted on the Platform with a revised effective date.

Continued use of the Platform after such updates constitutes acceptance of the revised Terms.


16. Severability

If any provision of these Terms is found to be invalid or unenforceable under applicable law, the remaining provisions shall remain in full force and effect.


17. Entire Agreement

These Terms, together with the Privacy Policy and any additional agreements entered into between the User and Smart Hiring Gulf, constitute the entire agreement governing use of the Platform.
